1Who these terms are between

Yummiable is made and run by Whats4Dinner LLC, a Washington limited liability company ("we", "us", "our"), at 8201 164th Ave NE, Ste 200, PMB 064, Redmond, WA 98052, USA.

These terms are an agreement between us and you, the grown-up who downloads the app, creates an account or buys a subscription. By using Yummiable you accept them. If you do not accept them, do not use the app.

Children do not agree to anything: a grown-up is responsible for the app, the subscription, and the children who use it.

2What Yummiable is — and what it is not

Yummiable helps families learn about food together. Children meet foods, taste tiny amounts with a grown-up beside them, notice what their senses say, and keep a diary a grown-up confirms.

Yummiable is for educational purposes and does not replace individualized medical advice or 1:1 feeding therapy. More precisely:

2.1 Food information, allergies and safety

3Who may use Yummiable

4Accounts and your family

  1. Signing in. An account is for grown-ups only, and it is optional: children never have one, and the app works on a phone without one. With an account you can reset the grown-up passcode and join a family (§4.3). You sign in with Apple, with Google, or with an e-mail address or phone number and a 6-digit code we send. Clerk, our sign-in service, handles the sign-in; the privacy notice says what it receives. Keep your Apple or Google account, that address, that phone and those codes to yourself: anyone who has them can reach your family's data in the app. Tell us at once if you think someone else has got in (§20).
  2. What you tell us must be true — your own e-mail address, phone number or Apple or Google account, and that you are a grown-up allowed to use Yummiable under §3.
  3. Your family. A family has up to five grown-ups. The grown-up who creates it owns it: the owner invites grown-ups, removes them, and can hand the family over to another grown-up. Any other grown-up can leave it. An invitation is a link that works once, for seven days, and anyone who has it can use it — send it only to the grown-up you are inviting, and only invite grown-ups you trust with your children's information.
  4. Family sync is part of Premium (§5.3). It keeps the children's profiles, coins, Taste Passports and food diary the same on every family phone, and every grown-up in the family can see and change what is shared. The copy on our server is encrypted on your phones with a key only your family's phones have: we cannot read it. Before the first copy is made, a parent or guardian gives the verifiable consent that US children's privacy law (COPPA) requires; we record it and confirm it to you. Turning Family sync off in Settings deletes the copy on our server at once, and each phone keeps its own.
  5. Signing out and deleting. You can sign out on one phone, or delete your account, in Settings. Deleting your account deletes your sign-in and what our server keeps for you, and you leave the family, which stays for its other grown-ups. An owner hands the family over first; an owner who is the family's only grown-up deletes the family with the account. Deleting the family deletes it for every grown-up and erases its encrypted copy on our server at once; only a grown-up whose own subscription is active can do that. Deleting does not cancel a subscription (§5.2), and it does not touch what is on each phone: the children's profiles, coins and food diary stay there until you delete them or the app.

5Subscriptions and payment

  1. Yummiable's plans (currently Basic and Premium) are sold only through the Apple App Store or Google Play, never inside the app. The price, the period and what the plan includes are shown to you before you buy and in the store.
  2. A subscription renews automatically until you cancel it. You cancel it — and ask for a refund — in your App Store or Google Play subscription settings, under that store's rules. We cannot cancel or refund a store purchase for you.
  3. Each plan comes with a monthly allowance for the parts of the app that use generative AI (stories, painted pages, dish photos) and a limit on how many books your bookshelf keeps. The app shows how much of the allowance a billing period has used. Allowance left over does not carry into the next period. In a family (§4.3), any grown-up's Premium makes the whole family Premium, and when several grown-ups subscribe, their allowances add up.
  4. We may change prices, plans and what they include. A price change affects a renewing subscription only after the store tells you and you accept it, as that store requires.
  5. If your subscription ends, the app keeps working with the free parts of it, the plan's extras stop, and §8.3 says what happens to the books on our service.

6What you make with Yummiable

  1. Your material stays yours. The story ideas and names you type, the photos you take, and anything else you put into the app remain yours. We claim no ownership of them.
  2. What the app makes for you is yours to use. Stories, painted pages and dish drawings made from what you gave us are yours for your family's personal, non-commercial use, as far as we are able to grant that. They are produced by generative AI, so similar output may be produced for someone else, and nobody — including us — can promise that any given picture or sentence is unique or protectable.
  3. The license we need. So that the app can work, you give us permission to store, copy, transmit and process your material and the output — only to run the features you asked for (writing a story, painting pages, reading a photo, keeping your bookshelf, syncing your family's phones, and backing those up). We do not sell it, advertise with it, or use it to train AI models, and we do not share it beyond the service providers that deliver these features (described in the privacy notice).
  4. Yummiable itself stays ours. The app, its characters, artwork, food database, text and software belong to us or our licensors. You may not copy, sell, rent, reverse-engineer or build a competing product from them, or extract our food database or artwork.
  5. Generative AI is not always right. Stories and dish drawings are made by a machine; they can be inaccurate, odd, or wrong about a food. Read them with your child the way you would read any storybook, and do not treat them as nutrition, medical or safety information. If something looks wrong, tell us from Settings → Feedback.

7Dish photos — what we do and do not do

When you take or choose a photo of a dish, the app shrinks it, removes its location and camera details, and sends it to our service, which passes it to our AI provider to read and to draw. Then:

  1. We do not keep the photo. It is held in memory only while it is being read, the result is kept for a short time (currently up to ten minutes) so your app can collect it, and after that both are gone. Neither the photo nor the drawing is written to our storage or to our logs, and neither is used to train AI models.
  2. Our AI provider handles the photo under its own terms for the time it needs to answer and to police abuse of its service. The privacy notice names the provider.
  3. What you photograph is your responsibility. Photograph the plate. Do not photograph people — including your own children — and do not photograph artwork, book pages, packaging designs, menus or anything else protected by copyright that you do not have the right to use.
  4. We are not responsible for the content the app produces from your photo. We do not choose it, review it before you see it, or claim it. It is made automatically from what you supplied, you own it under §6.2, and you accept that it may be imperfect. If it ever reproduces something you believe is yours, §10 tells you how to tell us, and we will act on a valid notice even though nothing is stored.
  5. We screen requests automatically for obvious misuse, and may refuse a photo or a story idea. That screening is imperfect and is not a promise to review anything.

8Stories and your bookshelf

  1. Unlike photos, the stories you make are kept on our service so your family can read them again and on another phone — up to the number of books your plan includes. Your device keeps a copy too, so a book can be read offline. In a family, the bookshelf is the family's: its grown-ups share it, and the books of each one's own subscription join it.
  2. You can delete a book in the app ("Manage my books"). Deleting it removes it, with its earlier versions, from our service and from the device. Backups made for our own disaster recovery are overwritten in the ordinary course.
  3. When a subscription ends, books already on your phone stay readable there, and the books held on our service stay there until you delete them. To have them deleted at any time, write to us (§20).
  4. Sharing a book. If the app offers you a link to share a book, anyone with that link can read it: treat it like handing someone a copy. Do not put a child's full name, school, address or photograph into a story you intend to share. You can stop sharing in the app. §9 and §10 apply to anything you publish this way.

9Rules of use

You agree not to:

We may suspend or end access that breaks these rules, and we may stop a feature that is being abused.

10Copyright, and how to report an infringement (DMCA)

We respect copyright, and we expect the same from you.

What we host. Most of what you make never reaches us: dish photos and the drawings made from them are not stored (§7). Stories your family keeps are stored so you can read them (§8), and if the app lets you share a book, anyone with its link can read it. We do not review any of it before it exists; it is made automatically, by a machine, from what you supply.

Notices. If you believe something on our service infringes your copyright, send a written notice to our designated agent with all of the following (17 U.S.C. § 512(c)(3)):

  1. your physical or electronic signature;
  2. what work you say was infringed;
  3. what material you say infringes it, with enough detail for us to find it — for a shared book, the link;
  4. your address, telephone number and e-mail address;
  5. a statement that you believe in good faith that the use is not authorized by the copyright owner, its agent, or the law;
  6. a statement that the information in your notice is accurate and — under penalty of perjury — that you are the copyright owner or authorized to act for them.

Designated agent: Lei Jiang, Whats4Dinner LLC, 8201 164th Ave NE, Ste 200, PMB 064, Redmond, WA 98052, USA · telephone +1 225 454 5024 · e-mail lionel@fightraccoon.com. Our agent is registered with the US Copyright Office's DMCA Designated Agent Directory (registration DMCA-1077876).

We will remove or disable material we decide, in good faith, is the subject of a valid notice, and we will tell the family who made it.

Counter-notice. If your material was removed and you believe that was a mistake or a misidentification, send our agent a counter-notice with your signature; the material and where it was; a statement under penalty of perjury that you believe in good faith it was removed by mistake or misidentification; your name, address and telephone number; and your consent to the jurisdiction of the federal court for your district (or, outside the United States, for the Western District of Washington), and that you will accept service from the person who complained. We may restore the material in 10–14 business days unless we are told a court action has been filed.

Repeat infringers. We end the accounts of users who infringe repeatedly.

False claims. Under 17 U.S.C. § 512(f), someone who knowingly misrepresents that material is infringing — or was wrongly removed — may be liable for damages.

11Privacy and children

Our privacy notice explains what the app keeps, what the app sends, and what each service provider receives. It is also in the app. In short: a child's profile, coins, Taste Passport and food diary live on the device; the app does not send them to a server we run unless a family turns on Family sync, and then only encrypted, so that we cannot read them; we ask a parent or guardian for verifiable consent before that happens, as the Children's Online Privacy Protection Act requires. We don't track what you or your children do in the app, and it has no advertising and no third-party analytics or tracking tools. Only a grown-up can make an account or subscribe; children never do.

You confirm that you are the parent or legal guardian of every child whose information you put into the app, and that you consent to that information being handled as the privacy notice describes.

12Changes, availability, and ending

13Disclaimers

The app and the service are provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty that the service will be uninterrupted, secure, error-free, or that its content — about food, nutrition, allergens, history or anything else — is accurate or complete. §2 governs: the app is education, not care.

Some places do not allow these exclusions; there you have whatever warranties the law gives you, and the rest of this section still applies as far as it can.

14Limitation of liability

To the fullest extent the law allows:

15You cover claims you cause

You agree to cover us against claims, losses and reasonable legal costs arising from material you put into the app, from content you share, from your breach of these terms or of the law, or from how you used the app with your family — except to the extent we caused them.

16Disputes, and the law that applies

17Additional terms for apps downloaded from the Apple App Store

These terms are between you and us only — not with Apple, and we, not Apple, are responsible for Yummiable and its content.

18Additional terms for apps downloaded from Google Play

Yummiable is distributed through Google Play under the Google Play Terms of Service. These terms are between you and us, not Google. Google is not responsible for Yummiable, its content, or your subscription; refunds and cancellations follow Google Play's rules.
